1. Introduction

Paul A. Kubosh (“Company,” “we,” “us,” or “our”) operates the website https://www.kuboshdpsrecords.com (the “Site” or “Service”), through which users may request Texas driver records. We respect your privacy and are committed to protecting it through compliance with this Privacy Policy (“Policy”).

This Policy describes the categories of information we collect from and about users of the Service, how we use, share, retain, secure, and destroy that information, and the rights and choices available to you. By accessing the Site or using the Service, you consent to the practices described in this Policy. If you do not agree, do not use the Service.

This Policy is incorporated by reference into our Terms and Conditions, which separately govern the contractual relationship between you and the Company.

2. Scope and Key Definitions

In this Policy:

• “Personal Information” means information that identifies, relates to, describes, or could reasonably be linked to a particular individual, and includes “personal identifying information” as defined in Tex. Bus. & Com. Code § 521.002(a)(1) and “personal information” from a motor vehicle record as defined in 18 U.S.C. § 2725(3) and Tex. Transp. Code § 730.003(6).
• “Sensitive Personal Information” has the meaning given in Tex. Bus. & Com. Code § 521.002(a)(2) and includes information such as your name in combination with your Social Security number, driver license number, financial account number, or health information.
• “Driving Record” means the Texas driver record obtained from the Texas Department of Public Safety on your behalf through the Service.

3. Information We Collect

3.1 Information You Provide Directly

When you register for an account, place an order, contact customer support, or otherwise interact with the Service, we collect the information you choose to provide, which may include:

• Your full legal first name and last name (as shown on your Texas driver license);
• Texas driver license number;
• Driver license audit number;
• Last four digits of your Social Security Number, used solely to verify your identity with Texas DPS;
• Exact date of birth and driver license expiration date;
• Mailing address, e-mail address, and telephone number;
• Payment information (collected and processed by our third-party payment processor; see Section 5);
• Records and copies of any correspondence; and
• Any other information you choose to provide in connection with the Service.

3.2 Information Collected Automatically

When you access the Site, we and our service providers may automatically collect certain information about your device and use of the Site, including:

• IP address and approximate geographic location derived from that IP address;
• Device identifiers, operating system, browser type and version, and screen settings;
• Referring URL and the pages you view on the Site;
• Date and time of access and duration of your visit; and
• Information collected through cookies, web beacons, pixels, and similar tracking technologies.

3.3 Information from Texas DPS

In the course of providing the Service, we receive your Driving Record from the Texas Department of Public Safety. The contents of the Driving Record depend on the record type ordered and may include your photograph, date of birth, driver license number, address, and a list of crashes, violations, license status, and other driving history.

4. How We Use Information

We use the information we collect for the following purposes:

• To verify your identity and process your order with Texas DPS;
• To deliver your Driving Record to you by the method you select;
• To process payments and refunds and to manage your account;
• To communicate with you about your order, account, or support inquiries;
• To send service-related notices, including updates to these terms and policies;
• To monitor and improve the security, quality, and performance of the Service;
• To comply with applicable law, including the DPPA and Texas law; and
• To establish, exercise, or defend legal claims and to enforce our Terms and Conditions.

We do not sell your Personal Information. We do not use your Personal Information for behavioral advertising or for any commercial profiling purpose. We use information only as necessary to provide the Service and to comply with our legal obligations.

5. How We Share Information

5.1 Texas Department of Public Safety

We disclose the information necessary to identify you and to process your record request to the Texas Department of Public Safety, which maintains the original Driving Record.

5.2 Service Providers

We disclose information to third-party service providers that perform services on our behalf and that are contractually bound to use the information only for the purposes for which it was disclosed. These include payment processors, cloud-hosting providers, communications providers, and postal carriers.

5.3 Compliance with Law and Protection of Rights

We may disclose information when we believe in good faith that disclosure is necessary to comply with a subpoena, court order, or other legal process; respond to a lawful request from government authority; investigate suspected fraud; enforce our agreements; or protect the rights, property, or safety of the Company or the public.

5.4 Business Transfers

If the Company is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction, subject to confidentiality obligations.

6. Data Security

Consistent with the duties of a business under Tex. Bus. & Com. Code § 521.052, the Company implements and maintains reasonable administrative, technical, and physical safeguards designed to protect Sensitive Personal Information from unlawful use, unauthorized access, alteration, disclosure, or destruction. These safeguards include encryption of data in transit, tokenization of payment data, role-based access controls, logging, and secure destruction of records.

7. Cookies and Tracking Technologies

The Site uses cookies and similar technologies to operate the Site, remember your preferences, enable login functionality, measure performance, and detect fraud. You may control cookies through your browser settings, but blocking cookies may impair functionality. The Site does not currently respond to “Do Not Track” signals.

8. Data Retention and Destruction

We retain Personal Information only for as long as is reasonably necessary to provide the Service to you, to comply with our legal, accounting, tax, regulatory, or reporting obligations, to resolve disputes, and to enforce our agreements. When Personal Information is no longer needed, the Company destroys or arranges for the destruction of records containing Sensitive Personal Information in accordance with Texas law.

9. Data Breach Notification

The Company complies with the breach-notification requirements of Tex. Bus. & Com. Code § 521.053. If an unauthorized acquisition of computerized data compromises the security of Sensitive Personal Information, the Company will provide notice to each affected individual without unreasonable delay. We will also notify the Texas Attorney General and consumer reporting agencies if required by law.

10. Children’s Privacy

The Service is intended for individuals who are at least 18 years old. We do not knowingly collect Personal Information from children under 13. If we learn that we have collected such information, we will delete it promptly.

11. Notice to California Residents (CCPA/CPRA)

If you are a California resident, you have the right to know what information we collect, the right to request deletion or correction of your information, the right to opt-out of the sale or sharing of your information (we do not sell or share your data for behavioral advertising), and the right to limit the use of Sensitive Personal Information. You will not face discrimination for exercising these rights.

12. Notice to Texas Residents (TDPSA)

13. Your Choices

You can review and update account information by logging into your account. You may opt out of marketing emails, though we may still send service-related emails. You may request account closure by contacting support.

14. Third-Party Links

The Site may contain links to third-party websites not operated by the Company. We are not responsible for their privacy practices or content.

15. Users Located Outside the United States

The Service is operated from the United States. By using the Service, you consent to the transfer, storage, and processing of your information in the United States.

16. Changes to This Policy

The Company may revise this Policy from time to time. If we make a material change, we will post a notice on the Site or notify you by e-mail before the change takes effect. Your continued use of the Service constitutes your acceptance of the revised Policy.

You may access the Site only for lawful purposes. You may not use the Site to violate any laws, transmit spam, impersonate others, engage in harmful conduct, use automated scrapers or bots without consent, or introduce malware.

17.2 Accuracy of Information

The Company strives to keep the Site accurate, but does not warrant that descriptions, pricing, or other content is completely error-free. We reserve the right to correct errors without prior notice.

17.3 Governing Law

This Policy and any disputes arising out of it are governed by the laws of the State of Texas and applicable federal law, without regard to conflict-of-laws principles.
